1. Introductory Provisions

These Terms of Use constitute a legally binding agreement between you as the user and  MACALA TEAM DOO BEOGRAD, Starine Novaka 3, 11000 Belgrade, Company ID: 22095277, VAT: 114950128 (hereinafter: the “Company” or “Macala team”), which owns and administers the online platform available at  www.macalateam.com (hereinafter: the “Platform”).

By using the Platform, you confirm that you have read, understood, and fully accepted these Terms of Use. If you disagree with any part of the Terms, please do not use this service.

These Terms of Use constitute the entire agreement applicable to you. By accessing or using the web Platform, the user is legally bound by this agreement. The Terms apply each time the Platform is accessed.

3. Platform Description

The web Platform is designed for online job advertising by employers and job applications by candidates. It also contains supporting content that provides information on labor law, employment, and work permits for foreigners.

Any use of the Platform contrary to these Terms is deemed misuse and may result in sanctions.

4. Registration and User Responsibility

Registration is required to use certain functionalities. The user is obliged to provide accurate and complete information, to keep access credentials confidential, and is responsible for activities on the account.

The Platform may refuse registration, suspend, or permanently remove an account in the event of Terms violations or misuse.

User Obligations

• Use the Platform in accordance with the law and these Terms;
• Do not post false, offensive, unlawful, or misleading information;
• No misuse such as spam or impersonation.

The user selects a password and is responsible for its confidentiality. The user shall not use others’ data nor share their own with third parties. Any suspicion of misuse must be reported.

A registered user who is a natural person must be at least 18 years old. Registration for individuals is free of charge.

During registration, personal data are processed in accordance with the Law and the Notice on Personal Data Processing.

The Platform owner does not alter content posted by users; the user bears sole responsibility for such content. Macala team may proofread spelling without affecting substance.

The user retains copyright and warrants that they hold all necessary rights to the content they post.

The user may request deletion/modification of content; requests are executed immediately, except for items stored in automated backups.

Deactivation of an account disables the use of data with the option of reactivation; deletion permanently removes data.

By posting content, the user grants Macala team the right to transmit the content to an indefinite number of recipients.

5. Platform Rights and Obligations

The Platform is managed by MACALA TEAM DOO BEOGRAD, which ensures availability, functionality, and security.

Macala team reserves the right to:

• Determine which services are free and which are charged;
• Charge for services (posting, highlighting ads, additional options), with prices clearly displayed;
• Periodically change the price list and notify users via the Platform and/or email;
• Reject content not compliant with regulations, morals, or service quality;
• Process personal data in accordance with the Privacy Policy and the law;
• Suspend/deactivate accounts due to Terms violations, abuse, or non-payment;
• Temporarily limit access or modify functionalities for maintenance or improvement;
• Change the structure/design/features and restrict access to parts of the service if necessary;
• Undertake technical and legal protective measures (blocking, deletion, cooperation with authorities);
• Strive for reliability, but does not guarantee uninterrupted operation.

Price List and Price Changes

The current price list is available on the Platform. Changes apply from publication unless otherwise indicated.

Payment Methods

Payment is made according to instructions during ordering (cards, electronic payment, invoice, etc.).

Invoicing

Upon payment, an invoice is issued in accordance with Serbian tax and accounting regulations.

Refunds

Paid amounts are non-refundable, except in the case of a Platform error or an unfulfilled service not caused by the user. Refunds are decided individually based on a written request.

Right to Change the Service Model

Macala team may change the business model and introduce charges for services previously free of charge, with timely notice to users.

6. Advertising and Promotional Message

The transmitter of the promotional message is the Platform owner. The advertiser is responsible for the accuracy and legality of the message and the consequences of its publication. Macala team may correct spelling without changing the substance and has the right not to publish content that is unlawful or contrary to these Terms.

Macala team does not mediate employment and does not influence the content of any agreements between advertisers and candidates.

Ads are submitted via a form; if the fields are correctly completed and the content complies with the Terms, the ad will be published.

7. Guidelines

Registered users must respect the guidelines when posting content. Macala team may remove or refuse content particularly if it includes:

1. Personal data or information that violates privacy.
2. Insults, discrimination, hate speech, violence, or harassment.
3. Sexual or violent exploitation of people.
4. Nudity, excessive violence, offensive content, or links to adult content.
5. Requests for personal data from minors.
6. Endangerment of an individual’s privacy or security.
7. False/misleading information or promotion of illegal activities.
8. Infringement of copyright/related rights or other IP rights.
9. Spam, defamation, or mass messaging.
10. Hidden pages or password-protected access without basis.
11. Incitement of criminal activities, instructions for unlawful acts, viruses.
12. Requests for passwords or data for commercial purposes.
13. Unauthorized advertising, contests, or pyramid schemes.
14. Other people’s photos/videos without consent.
15. Violations of privacy, copyright, or other personal rights.

Strictly Prohibited Activities

• Criminal/delict activities (e.g., child pornography, fraud, drug distribution, gambling, pyramid schemes, viruses, IP infringement).
• Unauthorized advertising or sales via the Platform.
• Circumventing Platform security mechanisms.
• Identity impersonation.
• Accessing others’ accounts or disclosing passwords.
• Reducing system efficiency, sabotage, DDoS, etc.
• Falsifying metadata in content.
• Automated submissions and overloading the system.
• Distribution of malicious software.
• Use contrary to applicable laws.

8. Supervision and Sanctions

The Platform owner may monitor activities, investigate reports of violations, and take appropriate measures, including removing accounts/content and cooperating with competent authorities.

9. Amendments to the Terms of Use

We reserve the right to update the Terms and the Privacy Policy at any time. Changes take effect upon publication on the Platform. Continued use constitutes acceptance of the changes. We recommend periodic review.

10. Links to Third-Party Websites

Parts of the Platform may contain links to third-party websites. We are not responsible for their terms of use, privacy policies, availability, or content. A link does not constitute a recommendation or approval.

11. Intellectual Property Protection

Unless otherwise indicated, all content on the Platform is the intellectual property of MACALA TEAM DOO BEOGRAD and is protected under the regulations of the Republic of Serbia. Unauthorized use (business name, trademark, logo, etc.) constitutes an infringement.

Copying, downloading, distribution, or other use is permitted only with prior written consent. Sharing on social networks is allowed with clear source attribution, as well as personal/non-commercial use.

12. Use of Name, Trademark and Logo

The use of the business name, trademark, and logo is permitted only in accordance with the law, these Terms, and the Privacy Policy, or with prior written consent from Macala team. Any unauthorized use will be subject to legal protection.

13. Disclaimer

Except in cases of intent or gross negligence, we are not responsible for temporary unavailability, malfunction, or improper functioning of the Platform, nor for technical issues of internet service providers. We are not responsible for content posted by users, nor do we guarantee the behavior of third parties.

We are not liable for damage arising from the use of information from the Platform, nor for violations caused by circumstances beyond reasonable control (technical difficulties, interruptions, natural disasters, actions of third parties, etc.). The Platform may be temporarily unavailable due to maintenance or improvements.

14. Severability

If any provision is declared null and void, this shall not affect the validity of the remaining provisions, which shall remain in force.

15. Dispute Resolution

These Terms are governed by the laws of the Republic of Serbia. The parties will attempt to resolve disputes amicably, and if unsuccessful, the competent court shall be the Commercial Court in Belgrade (for legal entities) or the Basic Court in Belgrade (for natural persons).
